COMMUNITY CHOICE AGGREGATION PLAN STATUS AND SCHEDULE

The following brief summary is provided for convenience.

APPROVAL

The procedures call for the County, Cities and Towns to decide whether or not to join no later than June 19, 2009, following which there would likely be additional expenses for any community that decided to join later.

The County and the following cities in the county have voted to join the newly formed Marin Energy Authority (MEA).

City of Belvedere
Town of Fairfax
County of Marin
City of Mill Valley
Town of San Anselmo
City of San Rafael
City of Sausalito
Town of Tiburon

The City of Novato and the towns of Corte Madera, Larkspur and Ross have voted to not join at this time.

REQUEST FOR PROPOSALS

The MEA has received 12 proposals, of which 3 are fully responsive to the full terms of the MEA request for proposal and the balance of which offer various types of support and possible future development programs.

Those who have had a preliminary view of these three proposals state that they believe that from them they will be able to secure power under the terms proposed during the organizational steps, i.e. 25 % green at or less than PG&E rates and 100% green at no more than 10% above PG&E rates.

Accordingly, the full board has appointed an ad hoc Negotiating Committee, has selected the Shell Corporation as the leading bidder, has approved a draft contract and is negotiating with the Shell Corporation. As of February 11, 2010 a contract has not yet been signed.
